Peer Brands Host Agreement
1. Introduction
This Host Agreement ("Agreement") is made effective as of [Date] by and between Peer Brands ("Company") and the Host ("Host"). By listing a property on the Peer Brands platform, the Host agrees to comply with the terms and conditions set forth in this Agreement.
2. Host Responsibilities
Listing Accuracy: Host shall ensure that all information provided about the property is accurate and up-to-date. This includes descriptions, photos, amenities, and availability.
Property Maintenance: Host shall maintain the property in a clean, safe, and habitable condition. Host is responsible for routine maintenance and repairs.
Compliance: Host shall comply with all local, state, and federal laws and regulations regarding property rental, including obtaining necessary permits and licenses.
3. Booking and Payments
Exclusivity of the Connection: All bookings and related communications must be conducted through the Peer Brands platform. Direct bookings with guests found through Peer Brands are prohibited.
Payment Terms: Peer Brands will collect payment from the guest at the time of booking. Host payments will be issued within 7 days after the guest’s check-out and the dispute resolution period, minus Peer Brands' 10% service fee.
Cancellation Policy: Hosts must adhere to the cancellation policy selected at the time of
listing. Peer Brands will handle all refunds and cancellations according to
this policy. If a guest is a monthly subscriber, 30 days notice in writing at [email protected] or messaged through the platform is required.
4. Fees and Revenue Sharing
Service Fees: Peer Brands will charge a service fee of 12.5% per booking. This fee covers the cost of using the platform and associated services.
Security Deposit: Hosts may require a security deposit from guests. The terms and handling of the security deposit should be clearly stated in the listing.
5. Response Time
Hosts are required to respond to guest inquiries within 24 hours for best results. Timely responses help ensure a positive experience for guests and improve the Host's reputation on the Peer Brands platform.
6. Insurance and Liability
Insurance Requirement: Host is required to maintain adequate insurance coverage for their property. Peer Brands offers optional Host Protection Insurance for additional coverage.
Liability: Host is liable for any injuries or damages occurring on their property. Peer Brands is not liable for any claims arising from the rental of the property.
As a Host on Peer Brands, you acknowledge and agree to the following:
Insurance Requirement: It is a policy of Peer Brands that all business entities utilizing our services must hold a minimum general liability insurance policy of one million dollars ($1,000,000).
Proof of Insurance: By listing your space on Peer Brands, you affirm that you carry the necessary insurance coverage as outlined in our policy.
Liability Acknowledgment: You understand that it is your responsibility to ensure that your insurance policy is active and adequate to cover any potential claims that may arise from the use of your space by Guests.
7. Compliance: Failure to maintain the required insurance coverage may result in the removal of your listing from Peer Brands and potential legal liabilities.
8. House Rules and Policies
House Rules: Host must clearly define house rules in the listing. This may include policies on noise, pets, smoking, and use of shared amenities.
9. Guest Conduct: Hosts can report any misconduct by guests to Peer Brands. Peer Brands reserves the right to take appropriate action, including banning guests from the platform.
10. Termination
Termination by Host: Host may terminate this Agreement at any time by removing their listing from the platform. However, if Peer Brands is still facilitating a connection, the Host must either maintain that connection with Peer Brands' full involvement or ensure that the guest leaves the facility. This must be done with the approval and documentation from Peer Brands.
11. Termination by Company: Peer Brands reserves the right to terminate this Agreement and remove the Host’s listing for violations of this Agreement or for conduct detrimental to the Peer Brands community.
12. Non-Circumvention:
The Parties agree that they shall not, directly or indirectly, circumvent,
avoid, bypass, or obviate each other to avoid payment of fees or commissions in
connection with any business opportunities or transactions introduced by or
through Peer Brands.
13. Scope:
This clause applies to any and all business opportunities, transactions, or
relationships that arise from or are related to the services provided by Peer
Brands. This includes, but is not limited to, introductions to clients,
customers, vendors, partners, or any other contacts or relationships
facilitated by Peer Brands.
14. Constructive Termination:
The Host agrees to act in good faith when interacting with Peer Brands, its representatives, and its platform. Deliberate actions taken to cause disruptions, refuse compliance with software requirements, or otherwise undermine the agreement in an effort to force Peer Brands to terminate the agreement will be considered a breach. In such cases, Peer Brands reserves the right to seek damages for lost revenue, legal fees, and other costs incurred.
